第1条（適用）

本利用規約（以下「本規約」といいます）は、heri:sync（以下「当ショップ」といいます）がウェブサイト上で提供するオンラインショッピングサービス（以下「本サービス」といいます）の利用条件を定めるものです。本サービスを利用するすべてのお客様（以下「ユーザー」といいます）は、本規約に同意したものとみなされます。当ショップは、必要と判断した際にユーザーへの事前の通知なく本規約を変更することができるものとし、変更後に本サービスを利用した場合は変更後の規約に同意したものとみなされます。


第2条（商品の購入と契約の成立）

ユーザーは、当ショップが定める手続きに従って商品の購入を申し込むものとします。当ショップが注文を受領し、注文完了に関するメールを送信した時点で、ユーザーと当ショップとの間に当該商品に関する売買契約が成立します。商品の価格、仕様、在庫状況などは予告なく変更される場合があり、ご注文後に在庫切れが判明した場合には、当ショップの裁量により注文のキャンセルまたは代替案の提示を行う権利を有します。


第3条（配送および関税）

商品の配送は、当ショップ指定の配送業者を通じて行われます。配送地域ごとの送料は、注文確定時に提示される金額が適用されます。海外への発送において発生する関税、輸入税（VAT/GST等）、および通関手数料等は、すべて受取人であるユーザーの負担となります。これらは商品代金や配送料には含まれておらず、荷物到着時にユーザーが直接配送業者へ支払うものとします。特にアメリカ合衆国への発送については、現地の規制により商品価格の60％を超える高額な手数料が発生する場合があることを、ユーザーはあらかじめ承諾するものとします。当ショップは、現地の税関による検査や介入に起因する配送の遅延、およびそれらに関連して発生した費用について一切の責任を負いません。


第4条（返品・交換および受取拒否時の対応）

商品の返品、交換、またはキャンセルについては、当ショップが別途定める「返品・返金ポリシー」に従うものとします。ユーザーが関税や輸入手数料の支払いを拒否した場合、または不在等の理由により荷物が当ショップへ返送された場合、当ショップは受領済みの商品代金から、「往復の送料」および「返品に伴う諸手数料」を差し引いた金額のみを返金対象といたします。なお、パーソナライズ商品については、返送された場合であっても代金の返金は一切行いません。


第5条（Shopifyとの関係）

heri:sync はShopifyによって提供されており、これにより当ショップはお客様にサービスを提供できます。ただし、ストアでの販売および購入は heri:sync によって直接行われます。サービスを使用することにより、購入商品およびサービスに起因する傷害、損害、損失を含め、Shopifyお客様と heri:sync 間での販売のいかなる側面についても責任を負わないことを認め、これに同意するものとします。お客様はここに、heri:sync との購入および取引に起因または関連するすべての請求、損害、および責任からShopifyおよびそのアフィリエイトを明示的に免除します。


第6条（知的財産権）

本サービスを構成するすべてのテキスト、画像、ロゴ、デザイン等の著作権および知的財産権は、当ショップまたは正当な権利を有する第三者に帰属します。ユーザーは、これらの情報を当ショップの事前の書面による承諾なく、複製、転載、改変、その他の二次利用をすることはできません。


第7条（免責事項）

当ショップは、本サービスの内容および提供される情報について、その正確性、完全性、最新性を保証するものではありません。また、システムメンテナンス、通信回線の障害、天災地変等の不可抗力により本サービスが中断または停止したことによってユーザーに生じた損害について、当ショップは一切の責任を負わないものとします。


第8条（準拠法および裁判管轄）

本規約の解釈にあたっては日本法を準拠法とします。本サービスに関して紛争が生じた場合には、当ショップの本店所在地を管轄する裁判所を専属的合意管轄とします。

Terms and Conditions

Article 1 (Applicability)

These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for using the online shopping service (hereinafter referred to as the "Service") provided by heri:sync (hereinafter referred to as "the Shop") on this website. All customers who use this Service (hereinafter referred to as "Users") shall be deemed to have agreed to these Terms. The Shop reserves the right to modify these Terms at its discretion without prior notice to Users. Continued use of the Service after any such modifications shall be deemed as acceptance of the revised Terms.


Article 2 (Purchase of Products and Formation of Contract)

Users shall apply to purchase products according to the procedures prescribed by the Shop. A sales contract for the relevant product shall be formed between the User and the Shop when the Shop accepts the order and sends an order confirmation email. Prices, specifications, and availability of products are subject to change without notice. In the event of a stockout after an order is placed, the Shop reserves the right to cancel the order or propose alternative products at its sole discretion.


Article 3 (Shipping and Customs Duties)

Shipping of products shall be carried out by a carrier designated by the Shop. Shipping rates for each region will be applied as presented at the time of order confirmation. All customs duties, import taxes (VAT, GST, etc.), and customs clearance fees incurred for international shipments shall be the sole responsibility of the User (the recipient). These fees are not included in the product price or shipping charges and must be paid by the User directly to the carrier upon arrival of the package. Special Notice for Shipments to the United States: Users acknowledge and agree that shipments to the USA may incur high fees exceeding 60% of the product price due to local regulations. The Shop shall not be held liable for any delivery delays caused by customs inspections or interventions, nor for any costs associated with such events.


Article 4 (Returns, Exchanges, and Refusal of Receipt)

Returns, exchanges, or cancellations of products shall be handled in accordance with the "Refund Policy" separately established by the Shop. In the event that a User refuses to pay customs duties or import fees, or if a package is returned to the Shop due to absence or other reasons, the Shop will refund only the amount remaining after deducting the "round-trip shipping costs" and "return processing fees" from the original payment. Personalized Products: For products that have been customized with names, numbers, or badges at the User's request, no refunds will be issued under any circumstances, even if the package is returned to the Shop.


Article 5 (Relationship with Shopify)

The Shop is hosted on Shopify Inc. Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you. However, all sales and purchases made in this store are conducted directly with heri:sync. By using the Service, you acknowledge and agree that Shopify is not responsible for any aspect of the sale between the User and the Shop, including any injuries, damages, or losses resulting from the purchased products or services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising out of or related to your purchase and transactions with the Shop.


Article 6 (Intellectual Property Rights)

All text, images, logos, designs, and other content constituting this Service are the property of the Shop or third parties with legitimate rights. Users may not reproduce, reprint, modify, or otherwise make secondary use of this information without the prior written consent of the Shop.


Article 7 (Disclaimer)

The Shop does not guarantee the accuracy, completeness, or timeliness of the content or information provided through this Service. Furthermore, the Shop shall not be held liable for any damages incurred by Users due to the interruption or suspension of this Service caused by system maintenance, communication line failure, natural disasters, or other force majeure events.


Article 8 (Governing Law and Jurisdiction)

The interpretation of these Terms shall be governed by the laws of Japan. Any disputes arising in connection with this Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Shop's head office.
